Delivery, Returns & Right of Withdrawal Policy

2. Scope and related documents

This Policy applies to purchases made by consumers through the Mindgevity website.

It covers:

  • delivery of the DR7 Mind Harmony food supplement supplied in capsule form, referred to as the “Capsules”;

  • supply of the Mind Harmony digital guide, whether personalised or universal, referred to as the “Guide”;

  • the statutory right of withdrawal;

  • Mindgevity’s contractual extension of the withdrawal period to 30 calendar days;

  • return conditions;

  • refunds;

  • delivery damage and non-conformity; and

  • the distinction between withdrawal from the purchase contract and withdrawal of consent to personal-data processing.

This Policy forms part of the Mindgevity Terms of Sale.

Personal data are processed in accordance with the Mindgevity Privacy Policy.

If you purchase products wholly or mainly for business or professional purposes, the consumer rights described in this Policy may not apply.

3. Delivery of the Capsules

3.1 Delivery territory

Mindgevity currently delivers the Capsules to addresses in France.

Available delivery methods, delivery costs and the applicable delivery date or period are displayed during checkout before payment and may also be stated in the order confirmation.

3.2 Delivery period

Mindgevity will deliver the Capsules by the date or within the period communicated during checkout or in the order confirmation.

If no delivery date or period is specified, delivery will take place without undue delay and no later than 30 days after conclusion of the contract.

Delivery estimates may be affected by circumstances outside Mindgevity’s reasonable control. Mindgevity will inform you of a material delay where required.

3.3 Delay or failure to deliver

If Mindgevity does not deliver the Capsules by the agreed date or within the agreed period, you may request delivery within a reasonable additional period.

If delivery does not occur within that additional period, you may terminate the relevant contract in accordance with applicable law.

You may terminate the contract without first granting an additional period where:

  • Mindgevity has refused to deliver;

  • delivery by the agreed date was an essential condition of the contract; or

  • before entering into the contract, you informed Mindgevity that delivery by a specified date was essential.

If the contract is validly terminated because of non-delivery, Mindgevity will reimburse the amounts paid in relation to the terminated contract without undue delay and no later than 14 days after termination.

3.4 Delivery address

You must provide a complete and accurate delivery address and any additional information reasonably required by the carrier.

Mindgevity is not responsible for delay or failed delivery resulting from incorrect, incomplete or outdated information provided by you, except where mandatory law provides otherwise.

3.5 Returned parcels

If a parcel is returned to Mindgevity because of:

  • an incorrect or incomplete address;

  • refusal of delivery;

  • failure to collect the parcel;

  • unsuccessful delivery attempts attributable to you; or

  • another circumstance attributable to you,

Mindgevity will contact you after the parcel has been returned.

Depending on the circumstances and applicable law, Mindgevity may offer:

  • reshipment, with additional delivery costs payable by you where permitted; or

  • reimbursement of eligible amounts after deduction of costs that may lawfully be retained.

Refusing delivery or failing to collect a parcel does not, by itself, constitute a valid exercise of the right of withdrawal. You must clearly inform Mindgevity of your decision to withdraw.

3.6 Transfer of risk

The risk of loss of or damage to the Capsules passes to you when you, or a third party designated by you other than the carrier, take physical possession of them.

If you independently appoint a carrier that was not proposed by Mindgevity, risk may pass when the Capsules are handed over to that carrier, subject to applicable law.

4. Statutory right of withdrawal and contractual 30-day extension

4.1 Statutory period and Mindgevity extension

Consumers have a statutory right to withdraw from a distance contract within 14 calendar days without giving a reason, subject to the conditions and exceptions provided by applicable law.

Mindgevity voluntarily extends the period for exercising this right to 30 calendar days.

The period from day 15 to day 30 is a contractual benefit granted by Mindgevity. It does not replace or restrict the statutory 14-day right.

Except where this Policy expressly provides otherwise, the same notification procedure, return process and refund rules apply throughout the 30-day period.

The contractual extension does not restore a right of withdrawal that has been lawfully lost in relation to:

  • Capsules or other sealed goods opened after delivery where the health-protection or hygiene exception applies; or

  • a Guide whose supply has begun under the conditions set out in Section 7.

4.2 Calculation of the 30-day period

For the Capsules, the day on which you receive the goods is not counted. The 30-day period begins on the following day.

If:

  • one order contains several goods delivered separately;

  • one product consists of several lots or parts delivered separately; or

  • delivery is made in several instalments,

the period begins on the day after receipt of the final good, lot or part.

For a contract providing for regular delivery of goods during a defined period, the period begins on the day after receipt of the first delivery.

For the Guide supplied as digital content without a tangible medium, the day on which the contract is concluded is not counted. The period begins on the following day, subject to the rules on immediate supply and loss of the right of withdrawal in Section 7.

If the final day falls on a Saturday, Sunday, public holiday or non-working day, the period is extended until the next working day.

5. Exercising the right of withdrawal

5.1 Notification

To exercise your right of withdrawal, you must clearly inform Mindgevity of your decision before expiry of the applicable 30-day period.

You do not need to give a reason.

Your statement must be clear and unambiguous. You may:

  • use the model withdrawal form in Section 12;

  • email support@mindgevity.fr;

  • send a written statement by post to the address in Section 1; or

  • use the free online withdrawal function available on the Mindgevity website.

Use of the model form is optional.

Returning the Capsules without a withdrawal statement, refusing delivery or failing to collect a parcel is not sufficient by itself.

You are responsible for demonstrating that you notified Mindgevity before expiry of the applicable period.

5.2 Online withdrawal function

For orders concluded through the Mindgevity website, a free online withdrawal function is made directly and easily accessible on the website.

Mindgevity makes this function available throughout the full 30-day withdrawal period.

The function allows you to provide or confirm the information necessary to identify:

  • you;

  • the relevant order or contract; and

  • the electronic means through which you wish to receive acknowledgment.

After you submit the online withdrawal request, Mindgevity will send you an acknowledgment on a durable medium, normally by email. The acknowledgment will record the content, date and time of your request.

5.3 Effect of withdrawal

A valid exercise of the right of withdrawal within the applicable 30-day period ends the relevant contractual obligations, subject to:

  • applicable legal and contractual exceptions;

  • return of eligible Capsules;

  • any reduction in value caused by excessive handling; and

  • the rules applicable to a Guide whose supply has already begun.

6. Return of Capsules following withdrawal

6.1 Return period

After informing Mindgevity of your decision to withdraw, you must return the eligible Capsules without undue delay and no later than 14 calendar days after sending your withdrawal notice.

Do not return products to a carrier, payment provider, manufacturer or other service provider unless Mindgevity expressly instructs you to do so.

6.2 Return costs

Unless Mindgevity expressly agrees otherwise, you bear the direct cost of returning eligible Capsules.

This does not apply where:

  • Mindgevity failed to inform you that return costs would be payable by you;

  • the Capsules are defective, damaged, unsafe or non-conforming; or

  • mandatory law requires Mindgevity to bear the costs.

Mindgevity does not accept cash-on-delivery returns unless this has been agreed in writing in advance.

6.3 Proof of return

We recommend using a tracked delivery service and retaining proof of shipment.

You remain responsible for the return shipment until it is received by Mindgevity, subject to mandatory law.

6.4 Condition of returned Capsules

The returned Capsules must, to the extent applicable:

  • correspond to the relevant order;

  • be unused;

  • have all eligible inner blisters unopened and sealed;

  • be returned with their original packaging and accompanying materials; and

  • have been stored appropriately.

Opening only the outer cardboard box does not, by itself, prevent a return if all inner blisters remain unopened and sealed.

6.5 Inspection and diminished value

During the statutory 14-day period, you may handle and inspect the goods only to the extent necessary to establish their nature, characteristics and condition.

You may be responsible for any diminished value resulting from handling beyond what was necessary for that purpose.

Opening an inner blister is not considered necessary inspection and may trigger the health-protection or hygiene exception described in Section 7.1.

During the additional contractual period from day 15 to day 30, Mindgevity’s return benefit applies only if all inner blisters remain unopened and sealed and the other conditions of this Policy are satisfied.

7. Exceptions and limitations

7.1 Sealed Capsules

The right of withdrawal does not apply to sealed goods that are unsuitable for return for health-protection or hygiene reasons once they have been unsealed after delivery.

For the Capsules, the relevant seal is the inner blister packaging.

Opening only the outer cardboard box does not remove the right of withdrawal if all inner blisters remain unopened and sealed.

If an inner blister is opened after delivery:

  • the opened blister and the Capsules contained in it are not eligible for return under the right of withdrawal where the health-protection or hygiene exception applies; and

  • Mindgevity’s additional contractual return benefit from day 15 to day 30 does not apply to the Capsules component of that programme.

The treatment of any remaining sealed blisters during the statutory period will be determined in accordance with mandatory law and whether the product can reasonably be divided.

These restrictions do not limit your rights if the Capsules are defective, damaged, unsafe or non-conforming.

7.2 Immediate supply of the Guide

The Guide is digital content supplied without a tangible medium.

Mindgevity will not begin supplying the Guide before expiry of the statutory 14-day withdrawal period unless you have:

  1. expressly requested and consented to supply beginning immediately, before expiry of that period;

  2. expressly acknowledged that you will lose your right of withdrawal concerning the Guide once supply begins; and

  3. received confirmation of that consent and acknowledgment on a durable medium.

These declarations are collected through a separate checkbox that is not pre-selected.

Confirmation is normally provided in the order confirmation email before supply begins.

For the purposes of this Policy, supply begins when Mindgevity starts generating the Guide or makes it available to you, whichever occurs first.

Once supply begins after all the requirements above have been satisfied:

  • you lose the statutory right of withdrawal concerning the Guide; and

  • Mindgevity’s contractual extension to 30 days also ceases to apply to the Guide.

This applies to both personalised and universal Guides.

Loss of the right of withdrawal does not affect your statutory rights if the Guide is defective or non-conforming.

If Mindgevity begins supplying the Guide without satisfying the required consent, acknowledgment and confirmation conditions, you do not lose your statutory right of withdrawal and will not owe any amount for digital content supplied contrary to those requirements.

7.3 Reference value of the Guide

The Guide is included in the relevant programme and is not sold separately.

For withdrawal and refund calculations only, the contractual reference value allocated to the Guide is EUR 9.

If supply of the Guide has begun after the requirements in Section 7.2 have been satisfied, the EUR 9 reference value is not refundable under either:

  • the statutory right of withdrawal; or

  • Mindgevity’s contractual 30-day extension.

If:

  • supply of the Guide has not begun;

  • the right of withdrawal concerning the Guide has not been validly lost; or

  • the requirements in Section 7.2 have not been satisfied,

the EUR 9 reference value remains refundable to the extent required by applicable law and this Policy.

The EUR 9 reference value does not limit any refund, price reduction or other remedy available under the legal guarantee of conformity.

8. Personal-data consent and contractual withdrawal

8.1 Separate processes

Withdrawal of consent to personal-data processing and withdrawal from the purchase contract are separate legal processes.

Withdrawing consent under data-protection law does not, by itself:

  • cancel your order;

  • exercise the right of withdrawal from the purchase contract;

  • return the Capsules;

  • create an automatic right to a refund; or

  • affect processing based on another valid legal basis.

To withdraw from the purchase contract, you must follow the procedure in Section 5.

8.2 Personalised Guide consent

If you select a personalised Guide, Mindgevity requests separate consent to process:

  • your questionnaire answers;

  • generated results;

  • your personalised Guide; and

  • any data concerning health contained in your questionnaire answers.

If you withdraw this consent:

  • the questionnaire answers, generated results and personalised Guide processed solely on the basis of that consent will be deleted;

  • you will lose access to the personalised Guide; and

  • Mindgevity may no longer be able to provide or recreate the Guide without new information and, where required, new explicit consent.

Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

Withdrawal of data-processing consent does not, by itself, create a right to a refund if the Guide has already been supplied and the right of withdrawal has been validly lost.

Your statutory rights concerning defective or non-conforming digital content remain unaffected.

8.3 Optional product-improvement consent

Mindgevity may separately request explicit consent to use a pseudonymised copy of questionnaire answers, generated results and the parts of a personalised Guide strictly necessary to test and improve:

  • the questionnaire;

  • personalisation rules;

  • the quality of personalised Guides; and

  • related services.

This consent is optional.

Refusal or withdrawal of product-improvement consent does not affect:

  • your purchase;

  • delivery or return of the Capsules;

  • supply of or access to your Guide; or

  • your contractual or statutory withdrawal rights.

If this consent is withdrawn before irreversible anonymisation, Mindgevity will stop using the relevant personal data for product-improvement purposes.

8.4 Retention and access

Questionnaire answers, generated results and personalised Guides are stored in encrypted form for no longer than 12 months from generation of the Guide. They are then deleted or irreversibly anonymised.

Pseudonymised product-improvement data are retained for no longer than 12 months from generation of the Guide and are then deleted or irreversibly anonymised.

A personal link providing direct access to a Guide remains valid for 72 hours.

9. Refunds

9.1 Refund period

If your withdrawal is valid, Mindgevity will refund the amounts due without undue delay and no later than 14 days after being informed of your decision to withdraw.

For contracts involving the return of Capsules, Mindgevity may withhold the refund until:

  • the returned Capsules have been received; or

  • you provide evidence that they have been sent back,

whichever occurs first.

9.2 Amount refunded

Subject to the exceptions and conditions in this Policy, Mindgevity will refund:

  • the eligible price paid for the returned Capsules or withdrawn contract;

  • the cost of the least expensive standard delivery method offered by Mindgevity, where applicable; and

  • the EUR 9 reference value of the Guide if the Guide remains eligible for reimbursement.

Mindgevity applies these refund rules throughout the contractual 30-day withdrawal period.

Mindgevity is not required to refund:

  • additional delivery costs resulting from your choice of a delivery method more expensive than the least expensive standard method offered;

  • direct return costs lawfully payable by you;

  • any diminished value caused by handling beyond what was necessary;

  • the EUR 9 Guide reference value where the right of withdrawal concerning the Guide has been validly lost; or

  • any other amount that may lawfully be retained.

If standard delivery was provided free of charge, no separate delivery amount will be reimbursed because no separate amount was paid.

For a programme containing both Capsules and a Guide, if the Guide is no longer refundable but the Capsules remain eligible for return, the eligible programme refund will be calculated after deduction of the EUR 9 Guide reference value.

9.3 Refund method

Refunds are made using the same payment method used for the original transaction unless:

  • you expressly agree to another method; and

  • the alternative method does not result in any fee for you.

Mindgevity will not replace a monetary refund with store credit or a voucher without your express agreement, except where the original payment was made using such credit or voucher.

10. Damaged delivery, incorrect product and non-conformity

If the Capsules:

  • are damaged on delivery;

  • do not match your order;

  • are incomplete;

  • appear unsafe;

  • present a suspected quality issue; or

  • are otherwise non-conforming,

contact Mindgevity at support@mindgevity.fr as soon as reasonably possible.

Please provide, where available:

  • your order number;

  • a description of the issue;

  • photographs of the parcel and product;

  • photographs of any visible damage;

  • the batch or lot number; and

  • any other information reasonably required to assess the issue.

Do not use Capsules that appear damaged, contaminated or unsafe.

If the Guide cannot be accessed, does not correspond to the contractual description or otherwise appears non-conforming, contact Mindgevity using the same email address.

Mindgevity will assess the issue and provide an appropriate remedy in accordance with applicable law.

Failure to report an issue immediately does not, by itself, remove your statutory rights.

11. Statutory guarantees

Statutory guarantees are separate from the right of withdrawal and Mindgevity’s contractual 30-day extension.

The restrictions relating to opened blisters and supplied digital content do not limit your statutory rights where the Capsules or Guide are defective, unsafe or non-conforming.

Depending on the circumstances, consumers may benefit from:

  • the legal guarantee of conformity applicable to goods;

  • the legal guarantee of conformity applicable to digital content;

  • the legal guarantee against hidden defects; and

  • any other mandatory remedy available under applicable consumer law.

Available remedies may include:

  • replacement or another lawful remedy concerning the Capsules;

  • bringing the Guide into conformity;

  • an appropriate price reduction;

  • termination of the relevant part of the contract;

  • reimbursement; or

  • damages where legally available.

Detailed information about statutory guarantees is provided in Section 11 of the Mindgevity Terms of Sale.

The retention periods in the Privacy Policy do not shorten or remove statutory guarantee periods.

If information needed to recreate a personalised Guide has already been deleted, Mindgevity may ask you to provide the necessary information again and, where required, provide new explicit consent.

12. Model withdrawal form

Complete and send this form only if you wish to withdraw from the contract. Use of this form is optional.

13. Updates

Mindgevity may update this Policy to reflect changes to its products, services, procedures or applicable law.

The version applicable to an order is the version accepted or made available when the order is placed.

A later update does not retroactively change rights or obligations relating to an earlier order, except where required by mandatory law or expressly agreed with you.

The current version and effective date will be published on the Mindgevity website.

14. Language

This Policy may be made available in several languages.

If there is any inconsistency between language versions, the French version prevails to the extent permitted by applicable law.

This language clause does not deprive a consumer of any mandatory protection applicable in the consumer’s country of residence.

You can use this form to exercise your legal right of withdrawal. You do not need to give any reason.

If your request concerns delivery, a damaged parcel, the wrong product, or a question about how to use your program, our support team may be able to help before you submit a withdrawal request.

You may still proceed directly with the form at any time. After submission, we will send you an acknowledgment by email and process your request in accordance with our Delivery, Returns & Right of Withdrawal Policy.
