1. Legal notice and seller details

These Terms of Sale apply to purchases made by consumers through the Mindgevity website.
2. Products and digital content
Mindgevity offers programmes that may include:
-
the DR7 Mind Harmony food supplement, supplied in capsule form (the “Capsules”); and
-
the Mind Harmony digital guide, which may be supplied as a personalised guide or a universal guide (the “Guide”).
The Capsules are food supplements. They are not medicines.
A personalised Guide is digital content prepared using information provided by the customer through a questionnaire.
A universal Guide is digital content that does not require the customer to complete the questionnaire and is not personalised using questionnaire answers.
The Guide is included in the relevant programme and is not sold separately. For withdrawal and refund calculations only, the contractual reference value allocated to the Guide is EUR 9. This allocation does not affect the customer’s statutory rights concerning the Guide.
The essential characteristics of each programme, including its composition, quantity, instructions for use, price, delivery options, Guide type and any applicable programme duration, are presented on the relevant product page and during checkout.
3. Health and food supplement information
The Capsules are food supplements intended to supplement, not replace, a varied and balanced diet and a healthy lifestyle.
The Capsules and the Guide are not intended to diagnose, treat, cure or prevent any disease. The website, questionnaire, product information and Guide do not constitute medical advice, medical diagnosis or medical treatment.
Do not exceed the recommended daily dose stated on the product label or accompanying instructions. Keep food supplements out of the reach of young children.
If you are pregnant or breastfeeding, have a medical condition, take medication, have allergies or are unsure whether the Capsules or a programme are suitable for you, consult a qualified healthcare professional before use.
Nothing on the website or in the Guide should be used as a substitute for professional medical advice or emergency medical assistance.
4. Orders and contract formation
To place an order, the customer:
-
selects a product or programme;
-
reviews the essential characteristics and applicable price;
-
provides the required order, billing and delivery information;
-
reviews and, where necessary, corrects the order;
-
accepts these Terms of Sale; and
-
confirms the order and payment.
The final order button will contain the words “Order with obligation to pay” or an equivalent unambiguous statement confirming that placing the order creates an obligation to pay.
By placing the order, the customer:
-
accepts these Terms of Sale;
-
acknowledges having read the Delivery, Returns & Right of Withdrawal Policy; and
-
acknowledges having received access to the Privacy Policy.
Acceptance of these Terms of Sale does not constitute consent to any processing of personal data that requires consent. Any such consent is requested separately through a dedicated, unticked checkbox.
Before placing the order, the customer can review the order details, total price, delivery costs and payment information and correct any errors.
The contract becomes binding when payment is confirmed and Mindgevity sends an electronic order confirmation.
The order confirmation and applicable contractual documents are provided on a durable medium, normally by email.
Mindgevity may refuse or cancel an order in the event of:
-
payment failure;
-
suspected fraud or misuse;
-
an abnormal order or quantities inconsistent with personal use;
-
product unavailability;
-
incorrect or incomplete information;
-
a legal or regulatory restriction; or
-
a manifest pricing or technical error.
Where an order is cancelled after payment, Mindgevity will refund the amounts concerned without undue delay.
Mindgevity archives contracts where required by applicable law. The customer may request access to an archived contract by contacting support@mindgevity.fr and providing sufficient information to identify the order.
5. Prices and payment
Prices are stated in euros and include applicable taxes unless expressly stated otherwise.
Delivery costs and any other mandatory charges are displayed before the customer confirms payment.
Payment is made using the payment methods available during checkout.
Payment transactions and, where applicable, saved payment methods are handled by third-party payment providers or Wix payment tools. Mindgevity does not store complete payment-card details.
The customer must ensure that:
-
the payment information provided is complete and accurate;
-
the customer is authorised to use the selected payment method; and
-
sufficient funds or credit are available.
Mindgevity may suspend performance of an order until payment has been successfully received.
6. Customer accounts and access security
Customers may have access to an account area allowing them to view or update personal information, addresses, orders and payment information made available through the relevant payment provider.
The customer is responsible for keeping account credentials and personal Guide access links confidential.
The customer must inform Mindgevity promptly if they become aware of unauthorised access to their account or Guide.
The customer must not:
-
misuse the website;
-
attempt to access restricted systems or data;
-
interfere with website security or operation;
-
upload malicious code;
-
use the website for unlawful purposes;
-
conduct or data;
-
interfere with website security or operation;
-
upload malicious code unauthorised scraping or automated extraction;
-
reproduce protected website content without authorisation; or
-
infringe the rights of Mindgevity or third parties.
Mindgevity may suspend or restrict access to an account or website feature where reasonably necessary for security, fraud prevention, maintenance, legal compliance or prevention of misuse.
Mindgevity makes reasonable efforts to keep the website available but does not guarantee uninterrupted or error-free access. Access may be temporarily suspended because of maintenance, technical problems, security incidents or circumstances outside Mindgevity’s reasonable control.
7. Intellectual property
All website content, including text, designs, graphics, logos, trademarks, images, videos, product names, Guide content, questionnaires, personalisation rules, structure and layout, is protected by intellectual property rights belonging to Mindgevity or its licensors.
No intellectual property right is transferred to the customer.
The customer receives a limited, personal, non-exclusive, non-transferable and non-commercial right to access and use the website, Capsules and Guide for their own personal purposes.
The Guide may not, without Mindgevity’s prior written authorisation, be:
-
copied other than for the customer’s personal use;
-
distributed or made available to the public;
-
published;
-
sold or licensed;
-
modified or adapted for commercial use;
-
used to develop a competing product or service; or
-
used in a manner that infringes the rights of Mindgevity or a third party.
8. Delivery of Capsules
Mindgevity currently delivers Capsules to addresses in France.
Available delivery methods, estimated delivery times and delivery costs are displayed during checkout before payment.
Mindgevity will deliver the Capsules by the date or within the period stated during checkout or in the order confirmation.
If no delivery date or period is specified, delivery will take place without undue delay and no later than 30 days after conclusion of the contract.
The customer must provide a complete and accurate delivery address and any information reasonably required for delivery.
The risk of loss of or damage to the Capsules passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of them, subject to applicable mandatory law.
If a parcel is returned because of:
-
an incorrect or incomplete address;
-
refusal of delivery;
-
failure to collect the parcel; or
-
another circumstance attributable to the customer,
Mindgevity will contact the customer after the parcel has been returned.
Depending on the circumstances and applicable law, Mindgevity may offer:
-
reshipment, with additional delivery costs charged to the customer where permitted; or
-
a refund of eligible amounts after deduction of costs that may lawfully be retained.
9. Guide selection, questionnaire and data processing
9.1 Personalised Guide
A personalised Guide is prepared using the customer’s questionnaire answers and generated results.
The customer is responsible for providing information that is accurate and complete to the best of their knowledge.
Before Mindgevity processes questionnaire answers, generated results and the personalised Guide for this purpose, the customer is asked to provide separate consent.
Where questionnaire answers include data concerning health, Mindgevity requests the customer’s explicit consent.
Providing questionnaire answers is optional. A customer who does not wish to complete the questionnaire or provide the required consent may select a universal Guide where that option is available.
The personalised Guide is provided for general wellbeing support only and does not replace medical advice, diagnosis or treatment.
9.2 Universal Guide
A universal Guide does not require completion of the questionnaire.
Mindgevity processes only the information necessary to record the customer’s selection, provide the universal Guide and manage access to it.
9.3 Optional product improvement
Mindgevity may separately ask the customer for explicit consent to use a pseudonymised copy of:
-
questionnaire answers;
-
generated results; and
-
those parts of the personalised Guide strictly necessary for product-improvement purposes.
This optional processing may be used to test and improve the questionnaire, personalisation rules, the quality of personalised Guides and related services.
Consent to product improvement is separate and optional. Refusal or withdrawal of that consent does not affect the customer’s purchase or access to the Guide.
Until information has been irreversibly anonymised, pseudonymised information remains personal data.
9.4 Retention, access and withdrawal of consent
Questionnaire answers, generated results and personalised Guides are stored in encrypted form for no longer than 12 months from generation of the Guide. At the end of that period, they are deleted or irreversibly anonymised.
Pseudonymised product-improvement data are retained for no longer than 12 months from generation of the Guide and are then deleted or irreversibly anonymised.
A personal link providing direct access to a Guide remains valid for 72 hours. During the applicable retention period, the customer may request a new access link, subject to appropriate identity and security checks.
Where the processing of a personalised Guide is based on consent, the customer may withdraw that consent at any time.
Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
Withdrawal of consent for the personalised Guide will result in:
-
deletion of questionnaire answers, generated results and the personalised Guide processed solely on the basis of that consent; and
-
loss of access to the personalised Guide.
If product-improvement consent is withdrawn before irreversible anonymisation, Mindgevity will stop using the relevant personal data for product-improvement purposes.
Further information is provided in the Privacy Policy.
10. Right of withdrawal, returns and refunds
10.1 General right of withdrawal
Consumers have a statutory right to withdraw from a distance contract within 14 calendar days without giving a reason, subject to the conditions and exceptions provided by applicable law. Mindgevity voluntarily extends this withdrawal period to 30 calendar days.
The additional period from day 15 to day 30 is a contractual benefit granted by Mindgevity. Unless these Terms expressly provide otherwise, the same notification procedure, return conditions, exclusions and refund rules apply throughout the 30-day period.
For the Capsules, the 30-day period runs from the day after the customer, or a third party designated by the customer other than the carrier, receives the Capsules.
For the Guide, the statutory and contractual withdrawal rights are subject to Section 10.3. Once supply of the Guide has begun following the customer’s required express consent and acknowledgment, neither the statutory 14-day right nor Mindgevity’s additional contractual extension applies to that Guide.
The applicable time limits, procedure, return address, return costs, refund rules and model withdrawal form are set out in the Delivery, Returns & Right of Withdrawal Policy, which forms part of these Terms of Sale.
10.2 Capsules
The customer may exercise the right of withdrawal in relation to eligible Capsules in accordance with the Delivery, Returns & Right of Withdrawal Policy.
For health-protection and hygiene purposes, the relevant seal is the inner blister packaging.
Opening only the outer cardboard box does not, by itself, remove the right of withdrawal, provided that:
-
all inner blisters remain unopened and sealed;
-
the Capsules have not been used; and
-
the other return conditions are satisfied.
If an inner blister has been opened after delivery, the Capsules contained in the programme cannot be returned under the statutory right of withdrawal where the health-protection or hygiene exception applies.
This does not affect the customer’s rights where the Capsules are damaged, unsafe or non-conforming.
10.3 Immediate supply of the Guide
The Guide is digital content supplied without a tangible medium.
Mindgevity will not begin supplying the Guide before expiry of the 14-day withdrawal period unless the customer has:
-
expressly requested and consented to the supply beginning immediately, before expiry of that period; and
-
expressly acknowledged that the customer will lose the right of withdrawal for the Guide once its supply has begun.
These declarations are collected through a separate, unticked checkbox.
Mindgevity provides the customer with confirmation of that express consent and acknowledgment on a durable medium, normally in the order confirmation email.
Once supply of the Guide has begun after the required express consent and acknowledgment, the customer loses the statutory right of withdrawal in relation to the Guide. Mindgevity’s contractual extension of the withdrawal period to 30 days does not apply to a Guide once its supply has begun under these conditions.
The loss of the right of withdrawal does not affect the customer’s statutory rights where the Guide is non-conforming.
10.4 Guide reference value
The reference value allocated to the Guide for refund calculations is EUR 9.
Where the Guide has already been supplied after the required express consent and acknowledgment, the EUR 9 reference value is not refundable under the statutory right of withdrawal.
Where the right of withdrawal for the Guide has not been lost, the EUR 9 reference value will be included in any refund to the extent required by applicable law.
The reference value does not limit any refund, price reduction or other remedy due under the legal guarantee of conformity.
11. Damage, non-conformity and statutory guarantees
If the Capsules or Guide:
-
are damaged;
-
do not correspond to the order or product description;
-
cannot be accessed or used as contractually agreed; or
-
present a suspected quality or safety issue,
the customer should contact Mindgevity at support@mindgevity.fr as soon as reasonably possible.
Delay in contacting Mindgevity does not remove any statutory right available to the customer.

11.1 Statutory notice concerning the Capsules
The consumer has two years from delivery of the Capsules to invoke the legal guarantee of conformity where a lack of conformity appears.
During this period, the consumer is required to establish the existence of the lack of conformity, but not the precise date on which it arose.
Subject to the statutory conditions, the consumer is entitled to repair or replacement of the goods, without cost and without major inconvenience, within 30 days following the request.
If repair or replacement is refused, impossible, delayed beyond the statutory period, causes major inconvenience or fails to correct the non-conformity, the consumer may be or fails entitled to an appropriate price reduction or termination of the sale.
The consumer may obtain an immediate price reduction or termination where the lack of conformity is sufficiently serious. The consumer is not entitled to terminate the sale where the lack of conformity is minor.
Where goods are repaired under the legal guarantee of conformity, the original guarantee period is extended by six months.
Where the consumer requests repair but the seller requires replacement, the legal guarantee is renewed for two years from the replacement.
These rights arise under Articles L.217-1 to L.217-32 of the French Consumer Code.
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code. An action under that guarantee must be brought within two years from discovery of the defect. Depending on the circumstances, the consumer may retain the goods and obtain a price reduction or return the goods and obtain reimbursement.
11.2 Statutory notice concerning the Guide
The Guide is supplied as a one-off item of digital content.
The consumer has two years from supply of the Guide to invoke the legal guarantee of conformity where a lack of conformity appears.
During the first year following supply, the consumer is required to establish the existence of the lack of conformity, but not the precise date on which it arose.
The legal guarantee includes the provision of updates necessary to maintain conformity where such updates are applicable to the Guide.
The consumer is entitled to have the Guide brought into conformity without undue delay, without cost and without major inconvenience.
The consumer may be entitled to retain the Guide and obtain an appropriate price reduction, or to terminate the relevant part of the contract and obtain reimbursement, where:
-
Mindgevity refuses to bring the Guide into conformity;
-
conformity is delayed without justification;
-
conformity cannot be achieved without costs being imposed on the consumer;
-
bringing the Guide into conformity would cause major inconvenience; or
-
the lack of conformity persists after an unsuccessful attempt to remedy it.
The consumer may obtain an immediate price reduction or termination where the lack of conformity is sufficiently serious.
Any period during which the Guide is unavailable for the purpose of bringing it into conformity suspends the remaining guarantee period until a conforming Guide is supplied.
These rights arise under Articles L.224-25-1 to L.224-25-31 of the French Consumer Code.
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code for two years from discovery of the defect.
The retention periods described in the Privacy Policy do not limit the customer’s statutory guarantee rights. If personal data required to recreate a personalised Guide have already been deleted, Mindgevity may ask the customer to provide the necessary information again and, where required, provide new explicit consent.
12. Subscriptions
Unless the relevant product page and checkout expressly state that a programme is an automatically renewing subscription, Mindgevity programmes are one-off purchases for the period indicated.
If Mindgevity offers automatically renewing subscriptions, the applicable information will be displayed clearly before purchase, including:
-
the price;
-
billing frequency;
-
delivery frequency;
-
renewal period;
-
any minimum commitment;
-
the cancellation procedure; and
-
the consequences of cancellation.
Where required by law, an online subscription may be cancelled through a free, directly and easily accessible online cancellation function.
13. Personal data and cookies
Mindgevity processes personal data in accordance with its Privacy Policy.
The Privacy Policy explains, among other matters:
-
the categories of personal data processed;
-
processing purposes and legal bases;
-
processing of questionnaire and health-related information;
-
pseudonymisation and anonymisation;
-
recipients and international transfers;
-
retention periods;
-
security measures; and
-
the customer’s data-protection rights.
Acceptance of these Terms of Sale does not constitute consent to processing that requires consent under applicable data-protection law.
Consent relating to:
-
the personalised Guide;
-
optional product improvement;
-
marketing communications; and
-
non-essential cookies
is requested separately where required.
Information concerning cookies and similar technologies is provided in the Cookie and Similar Technologies Policy. Users may manage their choices through the cookie or privacy settings available on the website.
14. Liability
Mindgevity is responsible for performing its obligations in accordance with applicable consumer law.
Mindgevity does not exclude or limit liability where such exclusion or limitation is prohibited by law, including liability relating to:
-
statutory guarantees;
-
fraud or intentional misconduct;
-
death or personal injury caused by fault or negligence; or
-
mandatory consumer rights.
Subject to mandatory law, Mindgevity is not responsible for loss or damage resulting from:
-
use of the Capsules contrary to the label or instructions;
-
exceeding the recommended daily dose;
-
use of the website or Guide as a substitute for professional medical advice;
-
inaccurate or incomplete information provided by the customer;
-
unauthorised disclosure of account credentials or personal access links by the customer;
-
misuse of the website, Capsules or Guide; or
-
an event outside Mindgevity’s reasonable control.
Information about cookies and similar technologies is provided in the Cookie Policy. Mindgevity does not currently use advertising cookies or other technologies requiring prior consent. If such technologies are introduced, they will not be activated before the user has made a choice through an appropriate consent mechanism.
15. Consumer mediation
In the event of a dispute relating to an order, the consumer must first submit a written complaint to Mindgevity at:
If the dispute is not resolved directly, the consumer may refer it free of charge to Mindgevity’s appointed consumer mediator, subject to the admissibility requirements established by applicable law:

The request must generally be submitted to the mediator within one year from the customer’s written complaint to Mindgevity.
Mediation is conducted in French.
The consumer remains free to bring proceedings before a competent court.
16. Applicable law and disputes
These Terms of Sale and the corresponding contracts are governed by French law.
This choice of law does not deprive a consumer residing in another country of any mandatory protection granted by the law of that country where such protection applies.
In the event of a dispute, the customer may bring proceedings before any court having jurisdiction under applicable consumer and civil-procedure rules.
No provision of these Terms requires the consumer to bring proceedings exclusively before a court designated by Mindgevity.
17. Updates
Mindgevity may update these Terms of Sale to reflect changes in its products, services, business processes or applicable law.
The version applicable to an order is the version accepted by the customer at the time the order is placed, unless a subsequent mandatory legal provision applies.
Changes to these Terms do not retroactively alter contracts already concluded, except where required by mandatory law or expressly agreed with the customer.
18. Language
These Terms of Sale may be made available in several languages.
In the event of inconsistency between language versions, the French version prevails to the extent permitted by applicable law.
This language clause does not limit any mandatory consumer protection applicable in the customer’s country of residence.
